These Terms and Conditions ("Terms") govern your use of the mobile application Fikr ("App"), which is owned and operated by MUHAMMED RASHID KUZHIMPADATH ("Owner"). In these Terms, references to "Fikr", "we", "our", or "us" refer to the App and its operation, except where the full legal owner name is required for legal purposes.
By downloading, installing, or using Fikr, you agree to be bound by these Terms. If you do not agree, you must not use the App.
You must be of legal age in your jurisdiction or have the consent of a parent or guardian to use the App. By using the App, you confirm that you meet these requirements.
These Terms apply exclusively to the current mobile application version of Fikr, available via the Apple App Store. Any future products, services, or platforms will be subject to their own terms.
Fikr grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use, subject to these Terms and the Apple App Store terms of service.
The App includes AI-powered features such as text suggestions, rewriting, tone adjustment, and translation. These features are intended to assist you in composing text. You acknowledge and agree that:
All transactions, including purchases, subscriptions, renewals, and cancellations, are handled exclusively through the Apple App Store. Your payment relationship is directly with Apple, and their terms and policies apply to all such transactions.
Subscription benefits will be available for the duration of your active subscription. You may cancel at any time through your Apple account settings, in accordance with Apple's cancellation policies.
Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your information. By using the App, you also agree to our Privacy Policy.
You agree not to use the App in any way that:
All rights, title, and interest in and to the App (including its content, code, design, and trademarks) are owned by Fikr or its licensors. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works based on the App.
The App is provided on an "as is" and "as available" basis, without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose, accuracy, and non-infringement.
To the fullest extent permitted by applicable law, Fikr and the Owner shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the App or AI-generated content, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the App or subscription in the 12 months preceding the event giving rise to the claim.
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, if you violate these Terms or engage in any prohibited conduct. Upon termination, your right to use the App will cease immediately.
We may update these Terms from time to time to reflect changes in our practices, services, or for other legal and operational reasons. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in India for the resolution of any disputes.
